1. Acceptance of Terms

By subscribing to any of our plans, you agree to be bound by these Terms and Conditions.

2. The Service Model (The "One-at-a-Time" Rule)

Design & Dev Tasks: Subscribing to Ema Cargnino grants you access to unlimited requests. However, requests are processed one at a time.

Workflows: We will only begin working on a new task once the previous one has been approved or completed.

Dev Partner Plan Specials: For active "Dev Partner" subscribers, managed hosting and one standard domain name (.com, .net, or .org) are included at no additional cost for the duration of the active subscription.

3. Ownership and Intellectual Property

Upon full payment of the monthly subscription, all original work created for the Client becomes the sole property of the Client. Ema Cargnino waives any rights to the work, except for the right to display the work in portfolios for promotional purposes.

4. Subscription, Pausing, and Cancellation

Billing: You will be billed monthly on a recurring basis.

Pausing: You may pause your subscription at any time. Remaining days in your billing cycle will be held for future use.

Cancellation & Hosting: You can cancel at any time. Upon cancellation, hosting and domain coverage will cease at the end of the current billing cycle. The Client is responsible for migrating the website to a new provider and taking over domain ownership/renewal costs after the subscription ends.

5. Refund Policy

Due to the high-intensity nature of the work and the time allocated to each client, all sales are final. No refunds will be issued once work has commenced.

6. Client Responsibilities

The Client is responsible for providing clear briefs and necessary assets.

• Design Partner: Client handles their own hosting/domain.
• Dev Partner: Ema Cargnino handles hosting/domain. However, the Client remains responsible for any premium third-party plugin licenses or specialized API costs required for their specific business needs.

7. Third-Party Assets

The Client is responsible for purchasing licenses for any third-party assets (premium fonts, stock photos, etc.) not explicitly included in the service.

8. Limitation of Liability

Ema Cargnino is not liable for any direct or indirect damages, including site downtime, data loss, or loss of profits. While we provide hosting for Dev Partners, we do not guarantee 100% uptime and rely on third-party infrastructure providers.
